Getting a Job in a Tough Legal Market

On February 7th, Rob Rausch moderated a panel at Albany Law School on the issue of “Getting a Job in a Tough Legal Market”.  Topics discussed included networking, drafting resumes, interviewing skills, and on-the-job etiquette.  The panelists included other graduates from Albany Law from a diverse selection of practice areas.  Rob is currently President-elect of the National Alumni Association.

Aaron Carbone Settles Deli’s Sales Tax Liability for less than 15% of Assessment

Recently, Aaron Carbone was successful in obtaining a settlement for his client, the owner of a small delicatessen, significantly reducing the client’s sales tax liability. The New York State Department of Taxation and Finance issued an assessment against this deli and its owner for over $210,000 in unpaid taxes, interest and penalties. This assessment was obtained by the department through an audit method used to estimate the deli’s tax liability. Aaron negotiated with the Office of Counsel and by revealing the mistakes and limitations of the methodology used to asses this deli he obtained a settlement reducing the total assessment against the deli and its owner as responsible person by over 85%. Aaron’s negotiation efforts with counsel for the tax department resulted in a significantly reduced liability for his client without the need for a hearing due to Aaron’s understanding of the laws regarding Sales Tax and applying the law to the facts of this case.

Maynard O’Connor proudly supports Operation Adopt a Soldier, Inc. This not-for-profit organization provides a wide range of services that support our American soldiers and their families. The lawyers and staff of Maynard O’Connor recently collected several boxes of items for shipment overseas to our soldiers for the holidays. We also plan to continue with donations throughout the year, and will offer pro bono legal services to the soldiers and their families, as needed.

Rob Rausch presents lecture on Defending Personal Injury Claims

On December 6th, Rob Rausch presented a lecture on “Negotiating and Litigating Damages: A Defense Perspective” at a Continuing Legal Education seminar sponsored by the National Business Institute. Rob addressed such issues as defenses to damage claims, use of surveillance, discovery of Facebook and social media, vocational rehabilitation evaluations, effective use of experts, and sources for valuing injuries, among other topics.

Members of Firm Lecture on Personal Injury Litigation

On November 16th, Alex Stabinski and Rob Rausch presented lectures at Albany Law School, in conjunction with the school’s program to provide free Continuing Legal Education credit to recent graduates. Both discussed procedures and advice for successfully handling for personal injury litigation. Alex spoke on the topic of “Everything Pre-Suit”, including discussions on preparing a strong personal injury claim, initial client meetings, and investigation. Rob presented on the topics of “The Purpose, Procedure, and Strategy of Discovery”, and “Guidelines and Recommendations for Depositions”. Both are graduates of Albany Law School, and Rob is currently President-elect of the National Alumni Association.

Firm Supports 29th Annual “Dancing in the Woods” Benefit

For over twenty years, Maynard, O’Connor has proudly served as one of the sponsors of Dancing in the Woods, the annual black-tie gala to benefit Albany Medical Center Hospital’s Center for Childhood Cancer and Blood Disorders. The “Melodies Center” is the Capital Region’s primary provider of care to infants and children with leukemia, lymphoma, and other blood cancers. Rob Rausch, a partner in the firm, is the co-chair of the event, and has been involved with its planning and organization for sixteen years. This year, the event will be held on Friday, December 7th. Firm successful in representation of victims of unlawful foreclosure

Concetta Lomanto was recently successful in representation of plaintiffs in a case involving an unlawful foreclosure and seizure. Although the mortgage was not in default and a foreclosure action had never been commenced, the bank erroneously hired contractors to enter the home and illegally remove and destroy the residents’ personal property without their knowledge or consent. The firm successfully negotiated a settlement to compensate the clients for their lost personal property. “Illegal trash out” cases are an unfortunate consequence of the recent foreclosure crisis. The firm has been consulted by several other parties who have unfortunately lost property and suffered similar consequences.

Ed Tobin gives presentation to New York State Small Business Development Center

On September 18, 2012 Ed Tobin, a partner in the firm, gave a presentation to the New York State Small Business Development Center, attended by start-up businesses, addressing the typical legal issues and pitfalls encountered in getting underway in business. Ed has 24 years of business law and litigation experience and has put together a coursebook on Small Business Legal Fundamentals. “There are so many pitfalls that I see start-up businesses repeatedly encounter, pitfalls which can easily be avoided with some advance knowledge,” says Ed. In his presentation, Ed went over typical difficulties encountered with regard to independent contractors, insurance issues, problematic contract clauses, discrimination claims, non-compete agreements, and strategies to avoid litigation and governmental penalties. He also discussed common environmental hazards and remediation concerns and how to mitigate exposures in this arena as well.

Ed is a frequently invited lecturer on small business matters, requested by various incubator programs. He has volunteered 26 lectures to these programs since 2007.

Michael E. Catalinotto Prevails at Trial in Defending Anesthesiologist

Michael E. Catalinotto successfully defended an anesthesiologist and his group in a case in the Dutchess County Supreme Court. The plaintiff claimed that as a result of the malpractice committed by her anesthesiologist in performing a femoral nerve block following total knee replacement surgery, she suffered a permanent injury to her femoral nerve and the loss of the use of her right leg. Through the use of expert testimony and anatomic drawings, Mr. Catalinotto was able to demonstrate to the jury that the plaintiff’s injury to her femoral nerve was not caused by femoral nerve block but was caused by the compression from the tourniquet used by the non-party surgeon. The Jury found that the anesthesiologist and his group had not committed medical malpractice.

Super Lawyers magazine annually acknowledges outstanding attorneys in a variety of practice areas, based upon peer recognition and professional achievement. Bruce Bell was recognized for his successes in the field of “Personal Injury Defense: Medical Malpractice”. Rob Rausch was acknowledged under the category of “Personal Injury Defense: General”. The lists appear in the current issue of Super Lawyers and the September, 2012 issue of Hudson Valley Magazine.
