Concetta Lomanto, Esq. of Maynard, O’Connor, Smith & Catalinotto, LLP Obtains another Successful Verdict in Oneida County

Concetta Lomanto, Esq. of Maynard, O’Connor, Smith & Catalinotto, LLP represented a local emergency medicine physician at a recent trial in Oneida County Supreme Court in Utica, New York and a defense verdict was returned, the physician was vindicated and justice prevailed. The case involved complications that resulted from prostate cancer following a radical prostatectomy, which resulted in the need for implantation of an artificial urinary sphincter. The case involved expert testimony in emergency medicine and urology. The key issue in this case was whether the emergency medicine attending physician met the accepted standard of care in approving the placement of a urinary catheter to relieve the patient’s urinary retention when the patient presented to the emergency department. After a two week trial, the unanimous verdict was returned in favor of the emergency medicine attending physician.

On September 5th, Paralegal Melissa DeSanto dropped off 17 backpacks full of school supplies donated by the employees of the firm to the Van Rensselaer Elementary School. Thank you to Melissa for organizing this and to those at Maynard that contributed.

Attorney Ed Tobin Successful in Defense of a Municipality and its Police Officers

Attorney Ed Tobin has concluded a 6 day trial in Federal Court, successfully defending a municipality and its police officers against claims of excessive force and the use of a Taser. It’s all about letting the jurors understand the standards of police practice and how a Taser actually has been demonstrated to reduce injuries. Ed has successfully defended several Capital District municipalities in police as well as other negligence claims for the last 25 years.

Rob Rausch lectures at Continuing Legal Education program

On April 28, 2017, Rob Rausch lectured at a New York State Bar Association – sponsored continuing legal education program regarding “Auto & Truck Claims, Accidents, and Litigation”.  Rob spoke on the topic of “Evaluating Damages and Use of Biomechanical Experts”.  Biomechanical engineering is a unique field of expertise, combining principles of physics and medicine, and is used to determine whether the forces exerted on the body in a particular accident are sufficient to cause injury.  Rob discussed the history of such experts and the manner in which such reviews are conducted, and offered practical advise for successful use of such theories at trial.  Rob has successfully presented such experts in defense of claims, and helped establish the prevailing appellate law on this topic.

Rob is a member of the New York State Bar Association and is a past president of the Capital District Trial Lawyers Association.

Lia B. Mitchell, concentrates her practice in the areas of medical malpractice defense, professional liability, personal injury, and general litigation. Lia is admitted to practice in the State of New York, the U.S. District Court for the Northern District of New York, and California (presently inactive). She is a member of the New York State Bar Association, Albany County Bar Association, and Capital District Women’s Bar Association.

Andrea P. Demers, concentrates her practice in the areas of medical malpractice defense, general litigation, premises liability, products liability, motor vehicle accidents, and employment law. Andrea is admitted to practice in the State of New York and the U.S. District Court for the Northern District of New York. Andrea is a   member of the Albany County, Capital District Women’s and New York State Bar Associations.

Rob Rausch lectures at Continuing Legal Education program

On November 5th, Rob Rausch lectured at Albany Law School, in conjunction with the school’s program to provide free Continuing Legal Education credits to recent graduates. Rob presented on the topic of “Litigating a Personal Injury Case: Plaintiff and Defense Perspectives”, along with Laura Jordan, a partner in the firm of Powers & Santola. Rob provided insight and recommendations for successfully defending personal injury litigation claims, and discussed such topics as effective use of social media and surveillance, critical details in a plaintiff’s medical records, and advanced deposition techniques, among other issues.

Rob is a 1994 graduate of Albany Law School, and is a past President of the Albany Law School National Alumni Association.

bake-offOn October 26th, with Halloween right around the corner, the talented bakers at Maynard O’Connor participated in the firm’s second annual Bake-Off.    Some of the tasty goodies included pumpkin trifle, scandinavian apple, pumpkin butterscotch muffins, upside down black russian banana cake, pignoli cookies, nameless treat, apple cider cupcakes & brown sugar cinnamon buttercream, magic cookie bars, maple bacon cupcakes with maple cream cheese frosting, and peanut butter chocolate chip cookies.

After serious deliberation by our esteemed judges, one of our associates, Bridget Schultz’s Pumpkin Trifle, took first place. Congratulations Bridget!
