Rob Rausch was recently successful in complete dismissal of a claim against a local hospital for treatment provided by an outside orthopedic surgeon. Rob moved for summary judgment and dismissal of the case, and argued that the hospital is not vicariously liable for the surgery and treatment provided by a private physician, and that there was no proof of any independent liability by any hospital employee. The court agreed, and granted the motion to dismiss the case against the hospital.
