MOSC recently secured summary judgment and dismissal of an action against a cardiologist and a local cardiology group. Plaintiff had alleged the cardiology defendants were negligent in allowing a liver biopsy to be performed soon after plaintiff was taken off of blood thinners. In support of their motion, we submitted proof, including expert Affidavits, demonstrating that the doctor’s medical judgment was accurate and that she had established appropriate precautions for surgery. Supreme Court, Saratoga County, agreed, noting that plaintiff has failed to submit sufficient proof to defeat defendants’ arguments and further noting that any subsequent changes to the treatment plan were made without the cardiologists’ knowledge and involvement. As a result, the Court granted summary judgment and dismissed the case against our clients.
