Rob Rausch was recently successful on a motion to dismiss a claim against a local ambulance company. The plaintiff claimed that during the course of an emergency transport, an EMS worker provided negligent medical care and that he also inappropriately touched her. Before any discovery took place, Attorney Rausch moved to dismiss the case, and argued that although the plaintiff made claims of “negligence”, those claims had not been raised in a timely manner, and that the claim was barred by the statute of limitations. The court agreed, and dismissed the claim in its entirety.
