Due to the ongoing health crisis surrounding the COVID-19 outbreak, Governor Andrew Cuomo has issued and Executive Order suspending the statute of limitations in New York State.
On March 20, 2020, Governor Andrew Cuomo signed Executive Order 202.8, which among other things, suspended all state statute of limitations. This includes but is not limited to time limits in the Criminal Procedure Law, the Family Court Act, the Civil Practice Law, the Court of Claims Act, the Surrogates Court Procedure Act and the Uniform Courts Act.
The Order specifically suspends all state statute of limitations, including, “any specific time limit for the commencement, filing, or service of any legal action, notice, motion or other process or proceeding,” through April 19, 2020.
