Rob Rausch successful in dismissal of two medical malpractice claims

Within the space of several days, Rob recently obtained dismissal of two separate medical malpractice claims.

In the first case, Rob successfully defended an emergency room physician who had allegedly failed to diagnose a patient with a stroke.  Rob presented proof, through the ER physician and an outside expert, that the patient had not demonstrated signs consistent with a stroke, and that the physician’s diagnosis was correct in all respects.  The court agreed, finding that the plaintiff’s claims were not supported by proof, and dismissed the case against that physician and the hospital in its entirety.

The second case also concerned claims of an alleged misdiagnosis in an emergency room department.  Rob defended the hospital and emergency room physicians, and successfully demonstrated that the action was procedurally defective, that the claims were barred by the statute of limitations, and that the underlying claims lacked any merit or support.
